Terms of Service
These Terms of Service ("Terms") govern access to and use of SurfaceDiff (the "Service"), operated by IT Consulting Marek Frueauff, NIP 631-107-40-96, registered at Szopena 11c/5, 44-120 Pyskowice, Poland ("SurfaceDiff", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you confirm you have authority to bind that company, and "you" refers to that company.
1. The Service
SurfaceDiff periodically scans domains you add to your account - subdomains, DNS records, open ports, TLS certificates, web services and crawlable endpoints - normalizes the results, compares each scan against the previous one, and surfaces the differences as incidents in your dashboard.
The Service is provided on a best-effort basis. Scanning is inherently incomplete: it can miss assets, misclassify findings, or fail to detect a change due to network conditions, rate limits, DNS propagation, or changes on the scanned infrastructure itself. SurfaceDiff is one input to your security process, not a substitute for it.
2. Authorization to scan
You may only add domains to SurfaceDiff that you own, control, or are otherwise explicitly authorized to scan and monitor. You are solely responsible for ensuring you have this authorization before adding a domain. We may suspend or remove a domain, or terminate your account, if we have reasonable grounds to believe it is being scanned without authorization.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@surfacediff.com if you suspect unauthorized access.
4. Subscriptions and billing
Paid plans are described on our pricing page and billed on a recurring basis in advance. Fees are exclusive of applicable taxes unless stated otherwise. Except where required by law or explicitly stated at the time of purchase, fees are non-refundable. We may change our pricing with reasonable notice; changes apply from your next billing cycle.
5. Acceptable use
You agree not to:
- Add or scan a domain you are not authorized to monitor;
- Use the Service to attack, exploit, or gain unauthorized access to any system;
- Interfere with the Service's operation or attempt to access it by means other than the interfaces we provide;
- Resell or provide the Service to third parties without our prior written consent.
6. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or that the Service will detect every exposure, be uninterrupted, or be error-free.
7. Limitation of liability
To the maximum extent permitted by law, SurfaceDiff's total liability arising out of or related to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim, and we will not be liable for indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or arising from an exposure or incident the Service did not detect or alert on. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Data
You retain ownership of the domains, configuration, and scan data associated with your account. How we collect, use, and store personal data is described in our Privacy Policy.
9. Termination
You may stop using the Service and delete your account at any time by contacting support@surfacediff.com from the email address associated with your account. Because this permanently removes your monitoring history, only the account owner may request it, and we will ask for confirmation via a link sent to that same address before deleting anything. We may suspend or terminate your account for breach of these Terms, non-payment, or if required by law. On termination, we will delete or anonymize your account data within a reasonable period, except where retention is required for legal or accounting purposes.
10. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date; continued use of the Service after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Poland. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent Polish courts, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
